The general contract conditions (present in the following pages: conditions of use, shipping and delivery, privacy) are applicable to all offers on this site (coltradeshop.com) of the company AMAC S.r.l.s. – Import – Export Engines – Tracked Machines – Via Circonvallazione 30 73040 Aradeo – Lecce – Italy – P.Iva 05127470754

By making the purchase, the buyer recognizes the effectiveness and applicability of these general conditions by accepting them without reservations (thus constituting the entire agreement between the parties).

The customer undertakes and obliges, once the “online” purchase procedure has been completed, to provide for the printing and conservation referred to in articles. 3 and 4 of the Legislative Decree. N°185/1999.

The buyer is strictly prohibited from entering false and/or fictitious data in the Online Order procedure necessary to activate the process for the execution of this contract and the related further communications; the personal data must be exclusively your own real personal data and not that of third parties or fictitious data.

The customer authorizes the company AMAC S.r.l.s. and undertakes to provide, at the latter’s discretion, a copy of unexpired identity documents. Failure to comply with the request for multiple documentation corresponding to the same person or to enter data of third parties. AMAC S.r.l.s. reserves the right to legally prosecute any violation and abuse, in the interest and protection of all consumers.

The Customer relieves the company AMAC S.r.l.s. from any liability deriving from the issuing of incorrect tax documents due to errors relating to the data provided by the Customer, the Customer himself being solely responsible for the correct insertion.

Any dispute relating to the application, execution, interpretation and violation of the “online” or fax sales agreements obtained through the coltradeshop.com website is subject to Italian jurisdiction; these general conditions refer, although not expressly provided therein, to the combined Legislative Decree. 50/92 e del D.Lgs. 206/05.

All advertised products are subject to constant technical updates by the manufacturers without any notice (according to improvement logics or rationalization of production processes). For this reason, data and descriptions are provided for indicative and non-binding purposes.

The stocks indicated are not synchronized in real time with the supplier’s warehouse, therefore the product may be unavailable. It will be our responsibility to notify the Customer and do everything possible to find the requested item from the supplier and ship it to the customer as soon as possible.

RIGHT OF WITHDRAWAL (pursuant to Legislative Decree 206 of 2005, also known as the Consumer Code)

Pursuant to Legislative Decree 206/05, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase indicating on the site “coltradeshop.com” a VAT number reference), has the right to withdraw from the purchase contract, if this has been stipulated and concluded remotely, for any reason, without the need to provide explanations and without any penalty, without prejudice to what is indicated in the following points.

1) To exercise this right, the customer must send AMAC S.r.l.s. a communication to this effect, within 14 days from the date of receipt of the goods. This communication must be sent by registered letter with return receipt to

5. This communication may also be anticipated via e-mail to co**********@gm***.com pas long as it is followed by sending by registered mail within 48 hours.

This communication must contain the buyer’s name and surname, no. Invoice and purchase date. Once the aforementioned notice of withdrawal has been received, AMAC S.r.l.s. will communicate to the Customer the instructions on how to return the goods which must reach us within 10 days of authorization.

2) The right of withdrawal is in any case subject to the following conditions: the right applies to products purchased in their entirety; it is not possible to exercise the withdrawal only on part of the goods purchased in the same transaction.

3) The purchased product must arrive in the same conditions as it was received, unused and in its normal state of conservation in all its parts, provided with the original packaging complete in all its parts and in perfect condition (it is considered an integral part of the object ), and any manuals, accessories, parts, keys etc. without any shortcomings. The absence of even one of these conditions will result in the forfeiture of this right and our company will return the purchased good to the sender, with shipping costs added to the sender.

4) To limit damage to the original packaging, we suggest, when necessary, inserting it in a second box, avoiding in all cases the affixing of labels or adhesive tapes directly to the original packaging of the product.

5) The user will forward the product to our company’s logistics structure via his own forwarding agent, subject to authorization for return which will be confirmed by us. Shipping costs are charged to the customer.

6) The shipment, until receipt is certified in our warehouse, is under the complete responsibility of the Customer. It is therefore advisable to insure the shipment against theft, loss or damage during transport. In the event of damage to the goods during transport, we will promptly inform the customer of the incident, to enable him to file an immediate complaint against the courier he has chosen and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, simultaneously rejecting the request for withdrawal (or alternatively reserving the right to charge for any damage suffered by the objects).

7) Upon arrival, the product would be examined to assess any damage or tampering not resulting from transport. If the existence of all the conditions regarding the condition of the goods indicated above in point “3” is not found, the right of withdrawal would lapse and the product would be made available to the buyer for its return.

8) In all other cases we will reimburse the customer the amount incurred (excluding cash on delivery costs in the event that the customer paid for the goods on delivery or other costs for ancillary services), within a maximum of 14 days from the return of the goods, by bank transfer (following the transaction by the customer of their bank details) or by reimbursing the amounts through Pay Pal or credit card if the user had used these 2 payment methods.

AMAC S.r.l.s. has the right to withdraw from the sales agreement within 30 days from the order date by providing the customer with a simple reasoned communication.

a) If it is impossible to process the requested order due to the unavailability, even temporary, of the product ordered (pursuant to art. 54, paragraph 2 of Legislative Decree 206/05)

b) If reasons arise that make the transaction not executable in the established conditions and procedures.

In such cases the customer will only have the right to a refund of any money already paid.

All products have a 2 YEAR guarantee.

The invoice must be kept for the guarantee on the products purchased.
